Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mulligan website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement.

2. Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. User content

You may submit ratings, comments, reviews, tee time postings, profile information, and other content ("User Content"). You retain ownership of your User Content, but you grant Mulligan a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and use such content for operating and improving the Service.

You are solely responsible for your User Content and represent that you have the rights necessary to post it.

4. Acceptable use

You agree not to:

  • Violate any applicable law or regulation

  • Impersonate any person or entity

  • Post false, misleading, defamatory, harassing, or infringing content

  • Use the Service to scrape, mine, or reverse engineer data except as allowed by law

  • Interfere with the operation or security of the Service

  • Circumvent access controls or claim tee times fraudulently

5. Tee time sharing disclaimer

Mulligan may provide tools that allow users to post, view, share, or claim golf tee times. Mulligan is not the golf course operator and does not guarantee the validity, transferability, price, eligibility, or availability of any tee time.

Any transfer, sharing, reimbursement, or other arrangement between users is solely between those users unless Mulligan explicitly states otherwise.

Users are responsible for confirming whether a course permits name changes, transfers, split payments, refunds, or substitutions.

6. Ratings and reviews disclaimer

Course ratings, reviews, and comments are opinions of users and do not reflect Mulligan's endorsement or verification.

7. Third-party integrations

The Service may integrate with third-party platforms or services, including GHIN or authentication providers. Your use of third-party services may also be subject to those providers' terms and policies.

8. Intellectual property

The Service, including its design, text, graphics, branding, software, and other content provided by Mulligan, is owned by Mulligan or its licensors and is protected by intellectual property laws.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms or if necessary to protect the Service or other users.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MULLIGAN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Mulligan and its affiliates, officers, employees, contractors, and partners from and against claims, damages, liabilities, losses, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of [New York], without regard to conflict of laws principles, except where otherwise required by applicable law.

14. Changes to the Terms

We may update these Terms from time to time. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.
